Welcome to tech night! We ask that you please review these Terms of Service ("Terms"), which govern your access to and use of the tech night! website (https://technight.events) and any related services, profiles, or community platforms provided by tech night! (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use our Service.

In these Terms, "tech night!", "we", "us", or "our" refers to the organizers of the tech night! community (an unincorporated volunteer community based in California, USA). "You" or "user" refers to any individual accessing or using our Service. We appreciate your understanding and cooperation as we work together to build a respectful and enjoyable community.

Quick Summary

Using our service: By accessing tech night! website and services, you agree to these Terms. The Service includes our website, profiles, and community platforms (see About Tech Night!).

Account requirements: You must be 13+ to use the Service (13-17 need parent consent). You're responsible for your account security and content (see Account Registration).

User conduct: Follow our Code of Conduct. No harassment, spam, illegal activity, or interference with the Service (see User Conduct).

Your content: You own your content but grant us a license to use it for operating the Service. You must have rights to any content you post.

Privacy: Your use of the Service is also governed by our Privacy Policy. We collect and use your information as described there (see Privacy section).

Disclaimers: The Service is provided "as is" without warranties. We're not liable for damages from your use of the Service (see Disclaimers).

Changes: We may update these Terms. Continued use after changes means you accept them (see Changes to Terms).

About Tech Night!

tech night! is a community organization that hosts inclusive social meetups, hackathons, and talks in the Orange County and Los Angeles, California areas. Our mission is "collaboration over competition" – creating welcoming environments where tech enthusiasts can step away from their screens and connect face-to-face. The Service provides an online platform for community members to create profiles (including a networking QR code for sharing contact info at events), learn about upcoming events (with links to third-party event platforms), and join our online community (e.g. our Discord server).

Please note: While we strive to foster genuine connections and a safe community, tech night! is not a commercial entity and events are often organized by volunteers. These Terms help ensure a respectful, lawful, and enjoyable experience for all participants. We appreciate your understanding and cooperation as we work together to maintain a positive community environment.

Eligibility

Age Requirements: The Service is intended for users age 13 and older. If you are under 13 years old, you are not permitted to use tech night! or create an account. If you are between 13 and 17, you may use the Service only with the involvement and consent of a parent or legal guardian. By using our Service, you represent that you meet these age requirements.

Geographic Scope: Our community is based in the United States, but people from any location are welcome to join. Be aware, however, that our Service and data are hosted in the U.S., and events are currently held in Southern California.

No Prohibited Users: You must not use the Service if you are barred from doing so under the laws of the United States or other applicable jurisdictions (for example, if you are on a U.S. government denied-party list).

Account Registration and Security

Account Creation: To use certain features of the Service, you may need to create a user account. You can register by signing in through Discord or LinkedIn. When you create an account, you agree to provide truthful, current, and complete information. Required information includes a name, email address (obtained from your OAuth login), and a unique username. You may also choose to add optional profile details like a bio, social media links, a profile photo, and a phone number.

Third-Party Login: When you sign in via Discord or LinkedIn, you authorize tech night! to collect your basic profile information (name, email, profile ID) as permitted by that platform's privacy settings. Your use of third-party login is subject to those platforms' terms and privacy policies (linked in the Third-Party Links section below). We do not access your messages, servers, or other data beyond what is necessary for authentication. You may connect both Discord and LinkedIn accounts; if you disconnect one, you can still access your account using the other as long as at least one remains connected.

Account Security: You are responsible for maintaining the confidentiality of any login credentials (such as your OAuth credentials or any session tokens) and for all activities that occur under your account. We ask that you please not share your account with others. If you suspect any unauthorized use of your account or a security breach, please notify us immediately at hey@technight.events. We are not liable for any loss or damage arising from your failure to safeguard your account information. Your cooperation helps keep everyone's accounts secure.

Account Profile: Your profile information (name, username, bio, social links, profile photo) will be visible to other community members and may be publicly accessible. Please do not include information you are not comfortable sharing publicly. Your email and phone number are private and used only for account management and emergency contact. You are responsible for ensuring your profile content is appropriate.

One Account Rule: Each user should create only one personal account. We ask that you please not create accounts on behalf of others or create multiple fake accounts. This helps us maintain an authentic community.

Account Deletion: You may request deletion of your account at any time by contacting us. Account deletion will remove your personal information from our live systems, though some data may persist in backups for a short period (see our Privacy Policy for details).

User Conduct and Community Guidelines

We are committed to fostering a friendly, inclusive, and safe community. By participating in tech night!, you agree to uphold our standards of conduct. This includes behavior on our website, at in-person events, and in online community spaces (such as our Discord server). We appreciate your cooperation in helping us maintain these standards, as they ensure everyone can participate in a positive environment.

Prohibited Conduct: You agree that you will NOT:

  • Violate Laws or Rights: Do not use the Service for any purpose that breaks any applicable law or regulation, or infringes the rights of anyone else (including intellectual property rights and privacy rights).
  • Harass or Harm Others: Please do not post or share any content that is threatening, harassing, bullying, or that encourages violence or self-harm. Hate speech, discriminatory remarks, and any content that attacks or maligns any person or group on the basis of race, ethnicity, religion, gender, sexual orientation, disability, etc. are strictly prohibited. This helps ensure our community remains safe and welcoming for everyone.
  • Post Inappropriate Content: Do not share anything obscene, pornographic, or otherwise objectionable through your profile or our community. This includes offensive language or images in your profile bio or photo. Keep your contributions professional and appropriate for a general audience.
  • Impersonate or Misrepresent: Do not impersonate any person or organization, or misrepresent your identity or affiliation with any person or entity. You must provide your own name (or preferred display name) and not purport to be someone you are not. Parody accounts or accounts designed to deceive others are not allowed.
  • Spam or Solicit: Please do not use the Service to send spam, junk messages, or unsolicited promotions. Your profile should not be used primarily as an advertising vehicle for commercial services, and we ask that you please not scrape our user list or attempt to contact other users with unwanted solicitations. This helps maintain a respectful community focused on genuine connections.
  • Interfere with the Service: Please do not attempt to interfere with the normal functioning of the website or community. This includes no hacking, scanning, or testing the vulnerability of our systems, no injecting malicious code, and no actions that impose an unreasonable load on our infrastructure (e.g., aggressive scraping or bots without permission). We appreciate your cooperation in helping us keep the Service running smoothly for everyone.
  • Circumvent Account Restrictions: If you are suspended or banned from tech night!, we ask that you please not create a new account to bypass that action. Similarly, please do not assist others in violating these Terms or in rejoining if they have been banned. This helps us maintain fair enforcement and protect the community.

Community Code of Conduct: Our in-person events and online forums are governed by our Code of Conduct. By attending events or participating in our Discord/community chats, you agree to abide by that Code of Conduct. Violations may result in removal from events, bans from our platforms, or other actions as deemed appropriate.

User Content and License: You retain ownership of content you provide. By posting content on your profile or through the Service, you grant tech night! a non-exclusive license to use, display, and distribute your content solely for operating and promoting the Service. We will not sell your content or use it beyond what is needed for the Service. You must have all necessary rights to any content you post. We reserve the right to review and remove any content that violates these Terms or our policies.

Privacy and Data Protection

Your privacy is very important to us. Our collection, use, and sharing of personal information in connection with the Service is described in our Privacy Policy (see below). By using the Service, you acknowledge that we will handle personal data as outlined in that policy. Key points:

  • We collect certain personal information when you use the Service, such as your name, contact information, profile details, and technical usage data.
  • We use this information to provide and improve the Service, communicate with you, and maintain a safe community.
  • We do not sell your personal data to third parties or use it for targeted advertising.
  • We share data only with service providers and platforms that help us run tech night! (for example, our website host, database provider, analytics service, and authentication providers), and we take steps to safeguard your data when doing so.
  • You have rights regarding your personal information (access, correction, deletion, etc.), and you can contact us via our contact page or email to exercise those rights.

Third-Party Links and Integrations

Our Service includes links or integrations to third-party platforms to enhance your experience and provide functionality. Please note that these are provided for your convenience, and tech night! does not own or control these third-party services. Examples include:

  • Event Platforms: Our website may list upcoming events and provide links to external event registration or information pages (such as Meetup, Luma, Eventbrite, or similar platforms). These external websites have their own terms of service and privacy policies. When you click those links or sign up for an event through those platforms, you are interacting directly with the third party, not with tech night!. We are not responsible for any issues arising from your use of external event sites. You can review Meetup's Terms of Service and Privacy Policy, Luma's Terms of Service and Privacy Policy, and Eventbrite's Terms of Service and Privacy Policy.
  • Discord and Social Media: We have a Discord community server and may link to social media pages (e.g., our Discord invite link, or social media profiles). Your participation in our Discord server is subject to Discord's Terms of Service and Privacy Policy, as well as our community's Code of Conduct. Similarly, any engagement with our content on social media (Twitter/X, Instagram, LinkedIn, etc.) is governed by those platforms' terms.
  • OAuth Providers: As noted, if you use LinkedIn, Discord, or other third-party accounts to log in, those services may receive data indicating that you are using our Service (e.g., they may log that you authenticated to tech night!). Any data those third parties collect or receive as part of the login process is governed by their privacy policies. You can review Discord's Terms of Service and Privacy Policy, and LinkedIn's User Agreement and Privacy Policy.

We do not assume any responsibility or liability for the actions, content, or practices of any third-party websites or services. We encourage you to read the terms and privacy policies of any third-party site you visit or service you use.

Intellectual Property

Our Content: All content and materials on the tech night! website and Service that we provide are protected by copyright, trademark, and other intellectual property laws. You may not use our name, logos, or proprietary content for commercial purposes without our prior written consent. You are welcome to share information about our events in a non-commercial manner as long as you do not imply endorsement by or affiliation with tech night! beyond what exists.

Your Use: We grant you a personal, non-transferable license to use the Service for your own personal, non-commercial purposes. You may not copy, distribute, modify, or create derivative works based on the Service without our permission, except as allowed by law.

If you believe that any content on our Service infringes your copyright or other intellectual property rights, please contact us with detailed information so we can investigate and address the issue.

Termination and Suspension

By You: You may stop using the Service at any time. You also have the option to request deletion of your account as described in Section 3 and in our Privacy Policy.

By Us: We reserve the right to suspend or terminate your access to the Service (including disabling your account) at our discretion, with or without notice, if we believe you have violated these Terms, the Code of Conduct, or any applicable law, or if you engage in behavior that we deem harmful to the community or the Service. We may also suspend the Service or your account for security reasons, technical issues, or due to inactivity.

When your account is terminated (by you or us), you may lose access to any content or data associated with your account. We are under no obligation to maintain or return your data after termination, except as required by law. We recommend that you keep your own copies of any information you want to retain (for example, the text of your bio or your profile picture) since we cannot guarantee it will be available after termination.

Even after termination of your account, certain provisions of these Terms will survive and remain in effect (for example, intellectual property rights, disclaimers, limitation of liability, governing law, and dispute resolution provisions will still apply).

Disclaimers

Service "As Is": Tech night! provides the Service on an "as is" and "as available" basis. Your use of the Service is at your own risk. To the fullest extent permitted by law, we disclaim all warranties and representations of any kind, whether express, implied, or statutory, including but not limited to any warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not guarantee that the Service will meet your requirements or expectations, that it will be uninterrupted, timely, secure, or error-free, or that any content (including event information or user profiles) will be accurate or reliable.

Community Events: Tech night! is a volunteer-driven community, and while we strive to organize safe and high-quality events, we do not make any guarantees regarding any events organized or advertised through our Service. Event details (such as location, time, and content) are subject to change, and we rely on third-party platforms for event registration which may have their own issues or downtime. We also cannot guarantee the behavior of any individual attendees at events. Please use common sense and caution when attending meetups or interacting with other members, just as you would in any public gathering.

Not Professional Advice: Any information presented on the Service (for example, blog posts, talks, or advice shared by members) is for general informational and community purposes only. Nothing on our site or at tech night! events constitutes professional advice (such as legal, medical, financial, or career advice) from tech night!. Always consult appropriate professionals for advice on specific issues you may have. We are not responsible for actions you take based on information you obtain from our Service or events.

Third-Party Content: We do not control or endorse content posted on third-party platforms (like Discord messages from community members, or content on external event pages). We make no warranties regarding any third-party content, and we are not liable for such content. Any third-party links provided through the Service are for convenience and informational purposes, and inclusion of a link doesn't signify endorsement by tech night!.

Some jurisdictions do not allow the exclusion of certain warranties or conditions, so some of the above disclaimers may not fully apply to you. In such cases, our warranties are limited to the minimum extent permitted by applicable law.

Limitation of Liability

To the maximum extent permitted by law, tech night! and its organizers, volunteers, partners, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Service;
  • Any conduct or content of any other user or third party on, through, or associated with the Service (including at in-person events or on the Discord community);
  • Any content obtained from the Service (including reliance on any information or materials obtained via our site or events); and
  • Unauthorized access, use, or alteration of your transmissions or content.

In no event shall the cumulative liability of tech night! (and its organizers and affiliates) for all claims related to the Service exceed the greater of U.S. $100 or the total amount you paid to us, if any, in the past twelve months for the Service.

The limitations above apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence), or otherwise, and whether or not tech night! has been informed of the possibility of such damage.

Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain damages. If laws applicable to your use of the Service do not allow the limitation of liability set out in this section, those limitations will apply to you only to the extent permitted by applicable law.

Governing Law and Dispute Resolution

Governing Law: These Terms and any dispute arising out of or relating to these Terms or the Service will be governed by and interpreted in accordance with the laws of the State of California, USA, excluding its conflicts-of-law principles. We operate primarily in California, and we're choosing California law to govern our agreement with you.

Jurisdiction and Venue: You agree that any claims or legal actions between us must be brought exclusively in the state or federal courts located in Orange County, California (or the appropriate court closest to Orange County if none is located within it). You consent to venue and personal jurisdiction in such courts. We each waive any objection to the venue or jurisdiction based on inconvenience or any other reasons.

Informal Resolution: We are a small community organization, and it's our hope to resolve any issues amicably. In the event of a dispute, please contact us first and attempt to resolve the matter informally. We're committed to working together to find solutions that work for everyone.

Changes to These Terms

Tech night! may revise or update these Terms from time to time. We will notify users of any material changes by posting the updated Terms on our website (and updating the "Last updated" date at the top). In some cases, we might also provide additional notice, such as an email to the address associated with your account or a prominent notice on our site, but we are not required to do so for changes.

Continued Use Deemed Acceptance: By continuing to access or use the Service after any revisions become effective, you agree to be bound by the updated Terms. If you do not agree to the new terms, you must stop using the Service and may request account deletion. We encourage you to review these Terms periodically to stay informed about our rules and your obligations.

Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy and our Code of Conduct (which are incorporated by reference), constitute the entire agreement between you and tech night! regarding your use of the Service. They supersede any prior agreements or communications (whether oral or written) between you and us regarding the subject matter. Any additional or different terms you seek to impose (for example, in any communication) are void and will have no effect.

Waiver and Severability: Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect, and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.
